Cancellation & Refund Policy

We understand that plans sometimes change. This page explains what happens if you need to cancel or move your Restaurant Magician booking.

The important bits

A £150 booking fee secures your chosen date and performance time.

If you cancel more than 14 days before your performance, you will not normally have to pay the remaining performance balance.

If you cancel within 14 days of your performance, the full booking price will normally become payable, subject to applicable consumer law and the provisions explained below.

1. The £150 Booking Fee

A £150 booking fee is payable when you make your booking.

This secures your chosen date and performance time and means that the allocated period is reserved for your event.

If you choose to cancel your booking, the £150 booking fee is non-refundable, subject always to your statutory rights and to any requirement under applicable law that an amount retained following cancellation is fair and proportionate.

2. Cancelling More Than 14 Days Before Your Performance

If you cancel more than 14 days before your booked performance date, you will not normally be required to pay the remaining performance balance.

The £150 booking fee will normally be retained because the date and performance time were reserved for you.

If you have already paid any amount towards the remaining performance balance, that amount will normally be refunded.

Any amount retained will remain subject to applicable consumer law and will not exceed an amount we are lawfully entitled to retain in respect of losses resulting from your cancellation.

3. Cancelling Within 14 Days of Your Performance

If you cancel within 14 days of your booked performance date, the full booking price will normally become payable.

Short-notice cancellations can make it difficult or impossible for us to obtain another booking for the date and time that had been reserved for your event.

Any cancellation charge will be limited where required by consumer law to a fair and reasonable amount reflecting the loss arising from your cancellation.

We will take reasonable steps to reduce our loss.

For example, if we are able to obtain a replacement booking for the same date and performance period, or otherwise avoid some of the loss caused by your cancellation, this will be taken into account when determining any amount payable or refundable.

4. Moving Your Booking to Another Date

If your plans change but you would still like Noel to perform, please contact us as soon as possible.

Where you request a change more than 14 days before your original performance date, we will make reasonable efforts to move your booking to another available date.

At our discretion, the £150 booking fee may be transferred to the replacement date.

All changes are subject to availability and are not confirmed until you receive written confirmation from Restaurant Magician.

Changes requested within 14 days of the booked performance may be treated as cancellation of the original booking unless otherwise agreed.

5. If Restaurant Magician Cancels

It is extremely unusual for Noel to cancel a confirmed performance.

If Restaurant Magician has to cancel your booking, we will contact you as soon as reasonably possible.

Where appropriate, we may offer another date or another mutually acceptable solution, but you are not required to accept an alternative.

Where Restaurant Magician cancels and the booked service cannot be provided, payments made for the affected service, including the £150 booking fee, will be refunded where required by law.

6. Circumstances Beyond Our Control

Occasionally an event may be affected by circumstances genuinely outside either party’s reasonable control.

Examples could include severe weather, significant transport disruption, serious illness or injury, accidents, fire, flood, venue closure, government restrictions or civil emergencies.

If circumstances such as these prevent the performance from taking place, we will make reasonable efforts to find a practical solution.

This could include altering the performance time or, where mutually agreed and availability allows, transferring the booking to another date.

Where the performance cannot take place, any refund or other remedy will be determined in accordance with applicable law.

7. Online Bookings & the 14-Day Cooling-Off Period

Many goods and services purchased online are subject to a statutory 14-day cancellation period.

Restaurant Magician bookings are for entertainment services provided on a specific date or during a specific period.

The statutory 14-day cancellation right that applies to many online purchases does not normally apply to this type of leisure-service booking.

Your cancellation rights are therefore principally governed by this Cancellation & Refund Policy and our full Terms & Conditions, together with any rights you have under applicable law.

8. How to Cancel or Change Your Booking

Please contact us as soon as possible if you need to cancel or change a booking.

Please include your name, event date and booking reference where available.

A cancellation or change is not treated as agreed until it has been acknowledged by Restaurant Magician.

9. Your Statutory Rights

Nothing in this Cancellation & Refund Policy is intended to exclude, restrict or otherwise affect any consumer rights or remedies which cannot lawfully be excluded or restricted.

Your statutory consumer rights remain unaffected.

Please get in touch as early as you can. Where possible, we would much rather help you rearrange your performance than have you cancel it.
